1. What these terms cover

These Terms govern your use of the PulseTrader Pro desktop application (the Software) and our website. By installing or using the Software you agree to them. If you do not agree, do not install or use it.

You must be at least 18 years old and legally able to enter a contract.

2. What the Software is — and what it is not

What it is. PulseTrader Pro is software you install and run on your own computer. It connects to your own account at a third-party cryptocurrency exchange (currently Bybit or OKX) using API credentials you create, and can place spot buy and sell orders on that account according to a fixed, rules-based strategy.

What it is not:

  • It is not financial product advice. Nothing the Software displays or does is a recommendation to buy, sell or hold any asset. We do not know your objectives, financial situation or needs, and nothing is tailored to them.
  • It is not a managed service. We do not trade on your behalf. We do not operate the Software for you. It runs only on your computer, only while you have it open.
  • We never take custody of your money or crypto. Your funds remain in your own exchange account at all times.
  • We never receive your API keys. They are encrypted and stored only on your computer.
  • We are not a broker, exchange, custodian or fund manager.

3. Your responsibilities

You are solely responsible for:

  • Every trade on your account — including the ones the Software places automatically while it is running;
  • Deciding whether to use live mode at all, and with how much money;
  • Your exchange account, its security, and complying with that exchange's terms;
  • Creating API keys with trade-only permissions (the Software refuses keys with withdrawal permission, but you remain responsible for what you create);
  • All taxes arising from your trading;
  • Ensuring your use is lawful where you live.

You should not trade with money you cannot afford to lose.

4. Paper mode and live mode

The Software starts in paper mode, which simulates trades against real market prices and places no orders. Switching to live mode is a deliberate act requiring explicit confirmation. In live mode the Software places real orders with real money.

Paper results are simulated. They do not account for every real-world factor (slippage, partial fills, outages, exchange downtime) and are not a prediction of live results.

5. Important limitations you must understand

  • Trading crypto is high risk. You can lose money, including all of it.
  • Stops only run while the app is running. Spot exchanges do not hold a stop-loss for a position. The Software evaluates stops on each scan while open. If your computer is off, asleep, offline, or the app is closed, no stop is being evaluated and your position is unprotected.
  • The Software depends on your internet connection, your computer, and a third-party exchange's API — any of which can fail, delay or misprice.
  • Automated systems can fail, including in ways that cause losses.
  • No strategy works in all market conditions. Past performance is not an indicator of future performance.

6. Subscription, billing and cancellation

  • Paid tiers are billed monthly in advance via Stripe.
  • Prices are in AUD and include GST.
  • Subscriptions renew automatically each month until you cancel.
  • You may cancel at any time; cancellation takes effect at the end of the current period, and you keep access until then.
  • Refunds. Because practice mode is free, unlimited and never expires, you can evaluate the Software fully before paying anything, so we do not offer change-of-mind refunds on a subscription period already started. This does not limit your rights under the Australian Consumer Law (clause 9), which apply regardless and cannot be excluded.
  • If your subscription lapses, the Software stops placing new orders. It does not close your existing positions — they remain yours to manage.
  • We may change pricing on 30 days' notice.

7. Licence

Practice mode is licensed to you free of charge, for as long as you wish, with no expiry. It simulates trades and places no orders.

Live trading requires a current paid subscription. We grant you a personal, non-exclusive, non-transferable licence to install and run the Software on one computer at a time. You may move it to a different computer (for example if you replace your machine).

Viewing your dashboard does not count as an install. The Software runs on one computer; opening its dashboard from a phone, tablet or another browser is just looking at that same running copy, and is expressly permitted. You must not copy, resell, sublicense, reverse-engineer, or attempt to circumvent licensing or tier limits, except where the law expressly permits it.

We retain all intellectual property in the Software and the strategy.

8. Availability and changes

We may update the Software, change or remove features, or change the strategy's rules. We will give reasonable notice of material changes where practical. We do not guarantee uninterrupted availability of the licensing service or website.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

Our goods and services come with guarantees that cannot be excluded under the ACL. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage.

10. Limitation of liability

Subject to clause 9, and to the maximum extent permitted by law:

  • We are not liable for any trading losses you incur, whether or not the Software placed the trades;
  • We are not liable for indirect, consequential, special or incidental loss, or for loss of profit, revenue, data or opportunity;
  • Where our liability can be limited but not excluded, we limit it — at our option — to resupplying the Software, or paying the cost of having it resupplied, or refunding the fees you paid us in the 12 months before the claim.

We are not liable for acts, failures or insolvency of any exchange, payment processor or other third party.

11. Suspension and termination

We may suspend or terminate your licence if you breach these Terms, use the Software unlawfully, or fail to pay. You may stop using the Software at any time. Termination does not affect positions open on your exchange account — those remain yours.

12. Privacy

We handle personal information in accordance with our Privacy Policy. We do not collect your trading data, balances, positions or API keys.

13. Changes to these Terms

We may update these Terms. Material changes take effect 30 days after we notify you or post the update. Continued use after that means you accept them.

14. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
